PAYMENT OF YOUR DEPOSIT CONFIRMS THAT YOU AGREE TO THESE TERMS & CONDITIONS
By agreeing to these terms & conditions you acknowledge & understand that you are entering into a legally binding contract, the terms of which are set out below.
“In writing” includes email.
“We”, “Our” or “Us” refers to NaturesLens.
“You” or “Your” refers to you, the customer.
We provide wildlife photography workshops, tours & holidays.
RESERVATION & PAYMENT
A reservation is made when (i) a booking form, together with deposit, has been received from you, & (ii) the booking is confirmed in writing by us. Upon confirmation of the reservation by us, a legally binding contract will be formed between you & us. Deposits are non-refundable & non-transferable, except where expressly stated.
You understand that wildlife photography can be a physically demanding activity. Accordingly, failure to disclose any serious physical, mental or health issue will constitute a material breach of contract, which will result in immediate termination of the services, your participation in the event, & this agreement, with no right of refund.
Balances are due by the date stipulated on the booking form. Unless notice of cancellation is received in writing prior to the balance payment date, balance monies will remain due & payable. If the balance is not received by the due date, your reservation is at risk & we may sell your place without further notice & without refund.
In the case of international payments, you must ensure that we receive the full GBP Sterling amount. You will be responsible for all bank charges, withholding taxes, & exchange rate fluctuations.
We reserve the right to return the deposit to you & refuse to accept your booking application for any reason whatsoever.
CANCELLATION & REFUNDS
You acknowledge that payment for the event is a fundamental part of the event’s income & contributes to the overall cost of equipment, running costs, staffing, administration & other expenses, & that we will have incurred the most of our costs before the actual commencement of the event.
If you need to cancel, you must request this in writing. We will use reasonable endeavours to resell your place. If we do resell your place, we will provide you with a refund minus a £100 admin fee, the deposit and any discounts given to sell your place. For the avoidance of doubt, if we do not resell your place, you will receive no refund whatsoever.
No refund will be made should you leave an event early.
There shall be NO REFUND for weather delay or cancellation because of weather before arrival, or during or after the scheduled event. We are not responsible for any additional costs that you may incur because of weather delays or cancellations due to weather, flight delays, or otherwise.
We reserve the right to cancel the event if the event is not financially viable due to insufficient numbers. If the event is cancelled due to insufficient numbers, an alternative event or a full refund (including the deposit) will be offered.
We reserve the right to terminate this agreement for convenience by giving you 30 days written notice. If we exercise this right of termination, you shall be given a full refund, including the deposit.
You are expected to conduct yourself in a manner that does not disrupt the event or the enjoyment of the other guests on the event, & to comply with all reasonable instructions of the NaturesLens tour leader(s).
If (i) you do not cooperate with reasonable requests or comply with reasonable instructions, or (ii) you are verbally &/or physically abusive in any way, or (iii) your conduct or behaviour, in a NaturesLens tour leader’s sole & absolute opinion, affects or potentially affects another guest’s enjoyment of the event, you will be deemed to be in material breach of contract, which will result in immediate termination of the services, your participation in the event, & this agreement, with no right of refund.
Verbal &/or physical abuse towards NaturesLens tour leader(s) will not be tolerated. We reserve the right to terminate any agreement in respect of any future event already booked without any right to refund, & to refuse to accept any further bookings from you.
PASSPORTS, VISAS & HEALTH MATTERS
Vaccinations, passports, visas, & all other country entry requirements are entirely your responsibility & must be arranged prior to departure. We accept no responsibility for the cancellation of your workshop/tour/holiday in the event that you are not allowed to travel, enter the relevant country, or participate in the event. If you are unable to travel due to not being able to obtain (or not having) the appropriate visa(s), you should submit a cancellation request. In accordance with our cancellation policy set out above, we will only provide a refund if we can resell your place.
You acknowledge that you are responsible for making yourself aware, through Foreign Office advice, State Department warnings & any other sources available to you, of the safety of the countries & areas in which you will be travelling, & to make your decisions accordingly. If you wish to cancel owing to FCO advice, you should submit a cancellation request. In accordance with our cancellation policy set out above, we will only provide a refund if we can resell your place.
You acknowledge & understand that wildlife photography can be physically demanding, & carried out in uncomfortable or difficult environments. All activities are entered into at your own risk. We do not accept responsibility for any loss or damage to your personal items &/or your equipment. We do not accept liability for death or personal injury unless caused by our negligence.
Any special dietary, allergenic, physical, medical or other needs/concerns should be communicated to us in writing with your booking form. We will inform the relevant supplier(s) of your requirements but we cannot guarantee that all requirements will be met & you accept that we have no liability to you if they are not met.
Workshops & photography holidays will begin at scheduled times. If you are late for any reason, you accept that we cannot delay in order to be fair to the rest of the group.
Whilst we are familiar with most current Canon & Nikon camera systems, you must have a working knowledge of all your equipment prior to the event.
We cannot be responsible for occurrences that are beyond our control, such as storms, snow, hurricanes, floods, fire, strikes, war, riots, acts of government, acts of terrorism, or acts of God (“Force Majeure Event”), that may make operation of the event impossible, illegal or inadvisable. If we need to cancel an event for any Force Majeure Event, a refund (less the deposit & any monies that have already been paid out) will be given. You accept that we will have no further liability to you.
We reserve the right to replace one or both tour leaders on a tour in the event of unforeseen circumstances such as serious illness of (one of) the tour leader(s) or one of their loved ones. We will try to replace a tour leader with someone with the same set of skills but we cannot guarantee this. You agree that you are not entitled to a refund in the event that we have to replace a tour leader. If you wish to cancel owing to replacement of a tour leader, you should submit a cancellation request. In accordance with our cancellation policy set out above, we will only provide a refund if we can resell your place.
We cannot guarantee that wildlife/photography subject matter will be present at any given location/time, & you accept that no refunds will be made due to a lack of wildlife/photography subject matter.
During an event, we will use services from various suppliers. We do not own or operate our suppliers, & we do not employ or otherwise have direction & control over their staff. Therefore we do not accept responsibility for the acts & omissions of any supplier or any third party.
We reserve the right to change the programme due to circumstances beyond our control. Any significant alterations will be advised to you as soon as possible. No refund will be made for any unused services that are included in the price. You understand that a tour may be subject to inconveniences caused by local conditions, such as traffic, weather, & local events, & those local facilities & amenities may not be comparable to those in the UK.
SURCHARGES & EXCHANGE RATES
You acknowledge that our third party suppliers are not under our direction or control and, in very rare circumstances, may impose price increases on their product(s) after we have agreed the price that you will pay for their services. We shall use reasonable endeavours to try to ensure any such surcharge will not apply to you. However, in the event that surcharges are unavoidable, we reserve the right to impose such surcharges.
In addition, we reserve the right to impose surcharges in the event that exchange rates significantly increase our costs in providing our services.
Surcharges will be calculated according to the full extra costs & current exchange rate compared to the costs obtained when the relevant tour package was produced & the exchange rates at that time. We will absorb the first 2% of any increase & 100% of any increase that becomes apparent in the last 30 days prior to departure. In exchange for this financial risk, you agree that we can impose a surcharge of 98% of our increased costs (which become apparent more than 30 days prior to departure) with no right of refund, other than cancellation in accordance with our cancellation policy.
It is not permitted to use NaturesLens to promote any workshops, seminars or photographic trips of any kind without our express written permission.
It is not permitted to solicit our customers, & you shall not to promote or market your own photographic workshops, seminars, tours, products, services, business &/or plans to our customers. This restriction shall continue to apply for a period of 5 years from the end of your participation in your last NaturesLens the event.
It is not permitted to solicit or deal with our suppliers with a view to setting up tours, products &/or services, which compete with NaturesLens. This restriction shall continue to apply for a period of 5 years from the end of your participation in your last NaturesLens event.
NaturesLens is not a travel agency & we do not book or take money for flights. You are responsible for your own travel arrangements both to & from our destination airport.
We reserve the right to add to or amend these terms & conditions at any time in our sole & absolute discretion. The most recent terms & conditions prior to departure will apply to the relevant tour, however, we will notify you of any significant changes.
